1. General Terms and Conditions of Sale

These General Terms and Conditions of Sale apply to all orders and all sales transactions on the website http://www.vintagevonk.com relating to the products offered for sale on the website http://www. vintagevonk.com. The website is owned and operated by VintageVonk, Bouchtweg 11, 1770 Liedekerke (Belgium), with VAT number: BE0760804652. VintageVonk (also reffered to as the "Seller", "we" or "us") is acting as the seller of the products listed on this website.

2. Applicability

These General Terms and Conditions apply to all orders placed through the vintagevonk.com webshop, through our instagram or through any other point of sale. By placing an order, the customer accepts the applicability of these General Terms and Conditions. These General Terms and Conditions can only be deviated from if this has been expressly agreed in writing and in which case the other provisions of these General Terms and Conditions remain in full force. VintageVonk reserves the right to change or supplement these General Terms and Conditions from time to time.

3. Order Confirmation

An agreement is concluded when an order confirmation from a customer has been sent by e-mail to the e-mail address provided by the customer. As soon as the order is confirmed by e-mail, the customer and VintageVonk have a valid agreement. This electronic confirmation serves, to the extent permitted by law, as a presumption of evidence. Only orders with a clear name, address and telephone number will be processed. Reserved items will be held for a maximum of 24h, after which payment is due. If payment wasn’t made within these 24h, reserved items will be offered for sale again, unless otherwise agreed in writing.

4. Personal data

The data provided by the customer will be treated confidentially by VintageVonk and will be used for the following purposes:

Processing the order, its payment and delivery to the correct delivery address
Promoting the user-friendliness of the webshop.

5. Product information

VintageVonk sells vintage items, meaning (possible) traces of use cannot be ruled out. This is part of the product. When buying an item without requesting further information, the customer automatically agrees to the condition of the item. Information, description, photos/images,.. provided either in the item’s description on the website, through our instagram, by e-mail or verbally are presented or made as accurately as possible. However, VintageVonk does not guarantee that all offers and products are fully consistent with the information provided, etc. In principle, deviations cannot give rise to compensation, return of an item and/or termination of the agreement. VintageVonk often sells the lighting with the original wiring that does not always (or no longer) meet current rules/standards. VintageVonk therefore recommends consulting an electrician before use. VintageVonk sells all lamps excluding the light bulb. VintageVonk cannot be held to its offer if the customer, according to reasonable social views, should have understood that the offer contains an obvious mistake or error. Because we sell through multiple platforms and because products cannot be automatically removed from the site after ordering, it is possible that a product is ordered/requested by two customers at the same time. In the unlikely event of this happening, the product will be sold to the person who ordered the product first.

6. Prices and Payments

All prices stated by VintageVonk are in Euros. As mentioned on the website, all prices exclude shipping costs. 95% of the items offered are margin items (so not VAT items) and fall under the margin scheme. For margin items, no VAT is stated on the invoice. VAT is therefore not deductible. If you want to know whether an item is a margin or VAT item, you can request this by email. Orders via the website can be paid in the following ways:

Cash payment upon collection of order (this is done by appointment, in consultation with the customer).
Payment in advance via bank transfer; the customer transfers the amount due including shipping costs to bank account BE54 0018 9928 9197 in the name of B. De Bisschop in Liedekerke, stating the item description as instructed by VintageVonk when making the reservation. The amount due must be credited to the relevant bank account within a maximum period of 1 day. To ensure sale has gone through within the agreed time, VintageVonk asks that the customer sends a proof of payment via instagram private message or email. If the reservation period of 1 day (24h) is exceeded without proof of payment, the agreement will be automatically terminated by VintageVonk. The product will only be shipped once the full total amount has been credited to the bank account. Once an item has been ordered, it will be listed as “reserved”. If payment has not been received 24h after ordering, the item will be put back on sale.VintageVonk expressly reserves the right to change prices, especially when this is necessary based on (legal) regulations. Special offers are only valid for the period of validity stated on the website in relation to that special offer.

7. Shipping

VintageVonk only offers delivery within Europe. The customer is liable for any sales tax and/or import duties & customs clearance formalities due. When you wish to have your item shipped, you must first contact us by email about the shipping costs. Different delivery conditions apply, depending on country, weight, measurements.. etc. All items are packed as well as possible for shipping. However, if damage occurs during shipping, VintageVonk is not liable for this. Upon receiving proof of payment, VintageVonk is ready to ship the order within 5 bussiness days. However, delivery might take longer depending on the shipping company. VintageVonk is in no way responsible for delays in shipping. Most shipping companies we work with will ship within 1-5 weeks, but the stated delivery time is indicative and never applies as a deadline. Exceeding any delivery period does not entitle the customer to compensation nor the right to cancel the order or terminate the agreement, unless the exceeding of the delivery period is such that the customer cannot reasonably be expected to maintain the agreement. Delivery takes place at the address specified by the customer during the conclusion of the agreement.

If possible, collection is always preferred, as this gives the customer the change to closely inspect the chosen item. Please note that collection of the goods is only possible by appointment! This will take place in consultation with VintageVonk. Appointments for pick-up need to be made at least 3 days in advance. We cannot make an appointment for pick up the same day as the day of purchase, nor the next day.

8. Ownership

Ownership of the products is transferred at the moment the products are presented at the delivery address specified by the customer. If the customer fails to accept the products, the resulting damage and costs will be at his or her expense.

9. Returns

If desired, an item can be returned at the customer's expense, meaning any return costs will be paid by the customer. It is also the customers responsibility to arrange shipping for this return, as well as to package the item before sending it. Packiging must be done carefully and in the same way as for delivery. Returns must always be reported by e-mail immediately upon receipt. You can return the item within 7 days after receiving it, provided that the item is in exactly the same condition as when it was sold. Costs incurred for shipping to the customer and/or returning or returning items are borne by the customer. The purchase amount will be returned after the process of return has been completed successfully, meaning the item was returned 7 days after purchase, carefully packed before shipping and arrives in exactly the same condition as when it was sold. VintageVonk reserves the right to refuse returns or to refund only part of the amount if these terms are not met, or if it is suspected that the products have been used or damaged by the customer or any other third parties.

10. Intellectual property

The customer expressly acknowledges that all intellectual property rights to displayed information, images/photos, communications or other expressions relating to the products and/or relating to the website or promotion thereof belong to VintageVonk or other rights holders. Photos and images from VintageVonk may not be used without permission.

11. Possible damage

VintageVonk is not liable for damage caused by third parties or for consequential damage due to incorrect use or due to a defect that VintageVonk could not have foreseen. VintageVonk is not liable for damage caused to an item that was in our stock awaiting pick up by a customer. We therefore urge you to pick up your items as soon as possible.

12. Applicable law and competent court

All rights, obligations, offers, orders and agreements to which these General Terms and Conditions apply are exclusively governed by Belgian law.
